These terms and conditions are attributed to all sorts of travel related transactions taking place on the website and are in compliance with legal obligations. These terms of use are entered into by and between you and ZoomFlightz ("Company," "we," "our," or "us").

The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these "Terms of Use"), govern your access to and use of ZoomFlightz along with the Company's mobile website and mobile and tablet applications (the "App"), including any content, functionality and services offered on or through ZoomFlightz, whether as a guest or a registered user.

The Website is provided solely to assist you in gathering travel information, determining the availability of travel-related goods and services, making legitimate reservations, or otherwise transacting business with travel suppliers, and for no other purpose.

Please read the Terms of Use carefully before you start to use the Website. By using the Website or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the Website.

This Website is offered and available to users who are 18 years of age or older, and reside in the United States or any of its territories or possessions or Canada. By using this Website, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

You represent and warrant that: (1) You are 18 years of age or older; (2) You possess the legal authority to create a binding legal obligation; (3) All information provided by you on the website is true, accurate, and complete; and (4) Your use of this website is limited but not restricted to making or managing travel reservations for yourself or on behalf of someone for whom you are authorized to act.

ZoomFlightz reserves the right to request documentation for any reservation that requires further validation from the cardholder. Cancellation may occur if the requested verification documents are not provided within the requested timeframe.

All changes are effective immediately when we post them, and apply to all access to and use of the Website thereafter. Your continued use of the Website following the posting of revised Terms of Use means that you accept and agree to the changes.

You are expected to check this page each time you access the Website so you are aware of any changes, as they are binding on you.

1. Nature of Promo Credit: Promo Credits are free, promotional rewards issued following a successfully ticketed booking. They are not gift cards, have no cash value, are non-refundable, and cannot be purchased, exchanged for cash, or redeemed for store credit. Promo Credits may only be used toward eligible travel bookings on our website.

2. Eligibility: Promo Credits are issued only when a booking is successfully ticketed (not merely reserved), the traveler provides a valid email address, and the booking is not cancelled, refunded, voided, or disputed. We may withhold or revoke Promo Credits if fraud, misuse, or inconsistencies are detected.

3. Promo Credit Amount: The amount issued is determined solely by the Company and may vary based on booking type, promotion, or seasonal offer. Marketing materials stating 'up to $100' indicate the actual amount awarded may be lower. The amount is shown in your email notification or e-ticket confirmation.

4. Expiration: Unless otherwise stated, Promo Credits expire 90 days from the date of issuance. Expired Promo Credits cannot be reinstated, extended, or replaced, and unused Promo Credits are forfeited at expiration.

5. How to Redeem: Enter the Promo Credit code during checkout. Promo Credits apply only to eligible base fare portions of a booking and may not reduce government taxes, airline-imposed fees, or third-party surcharges. Only one Promo Credit may be used per booking and cannot be combined or stacked.

6. Transferability: Promo Credits may be transferred one time to a friend or family member by forwarding the issued link/email. Once transferred, the original user loses all rights. Selling, trading, auctioning, or bartering Promo Credits is strictly prohibited.

7. Restrictions: Promo Credits may NOT be used for hotel-only, car-only, non-airline bookings, group travel, bulk/consolidator fares, past purchases, or airline ancillary upgrades (baggage, seat selection).

8. Cancellations & Chargebacks: If a booking is cancelled, voided, or refunded, any Promo Credit applied is forfeited. If a dispute or chargeback occurs on the booking that earned the Promo Credit, the credit is voided. If redeemed on a subsequent booking, the Company may deduct the value from any refund or charge the original payment method.

9. Limitation of Liability: To the fullest extent permitted by law, we are not liable for inability to redeem Promo Credits, lost codes, expired credits, or airline schedule changes. Promo Credits are goodwill promotional items.

License Grant: The App is licensed, not sold, to you. You do not acquire any ownership interest in the App. The Company and its licensors retain all right, title, and intellectual property rights in and to the App.

Updates: The Company may develop App updates, bug fixes, patches, and upgrades. Based on device settings, updates may download automatically or you may be prompted to download them. You agree to promptly install all updates.

Export Regulations & Government Rights: The App may be subject to United States export control laws, including the U.S. Export Administration Act. You shall not export, re-export, or release the App to any jurisdiction prohibited by law. The App is commercial computer software under 48 C.F.R. §2.101.

Availability: We will not be liable if all or any part of the Website is unavailable at any time or for any period. We may restrict access to some parts or the entirety of the Website to users, including registered users.

User Obligations: You are responsible for making all arrangements necessary to access the Website and ensuring all persons who access the Website through your internet connection comply with these Terms.

Account Security: If you choose or are provided with a username, password, or security credentials, you must treat such information as confidential. You agree to notify us immediately of any unauthorized access or breach of security, and exit your account at the end of each session.

Account Disabling Rights: We have the right to disable any username, password, or identifier at any time in our sole discretion if, in our opinion, you have violated any provision of these Terms of Use.

Permitted Use: These Terms permit you to use the Website for personal, non-commercial use only. You may temporarily store copies in RAM, store cached browser files, and print a reasonable number of pages for personal non-commercial use.

Prohibited Actions: You must not modify copies of materials, use illustrations/videos separately from accompanying text, or delete copyright/trademark notices. You must not access any part of the Website for commercial exploitation without prior written consent from support@zoomflightz.com.

Trademarks: The Company name, logos, product and service names, designs, and slogans are trademarks of ZoomFlightz or its affiliates/licensors. All other names and trademarks on this Website belong to their respective owners.

Prohibited Activities: You agree not to use the Website: in violation of any applicable federal, state, local, or international law; to harm or exploit minors; to transmit junk mail, spam, or solicitations; to impersonate the Company, employees, or other users; or to compete with or harass the Company or its partners.

Technical Restrictions: You agree not to: use the Website in any manner that could disable, overburden, or impair the site; use robots, spiders, scrapers, or automatic devices to access or copy content; introduce viruses, worms, trojan horses, or logic bombs; attempt unauthorized access to our servers, databases, or systems; or attack the Website via denial-of-service (DoS/DDoS) attacks.

License & Ownership: Any User Contribution posted is considered non-confidential and non-proprietary. By providing User Contributions, you grant us, our affiliates, and service providers a perpetual, royalty-free license to use, reproduce, modify, display, and distribute such material for any purpose.

Content Standards: User Contributions must comply with all applicable laws and must not: contain defamatory, obscene, abusive, or hateful content; promote discrimination or violence; infringe intellectual property or privacy rights; deceive any person; or impersonate any individual or entity.

Enforcement & Copyright Infringement: We reserve the right to remove User Contributions, disclose your identity to third parties claiming rights violations, and terminate accounts of repeat infringers. If you believe your copyright has been infringed, send notice to support@zoomflightz.com.

TCPA Consent: By submitting a travel request or booking, you expressly consent to be contacted by ZoomFlightz and Travel Service Providers via phone, fax, email, SMS/text messaging, or push notifications at any contact numbers provided, irrespective of federal, state, or local 'Do Not Call' registries. You authorize automated and prerecorded calls regarding your travel bookings and promotions.

RCS & SMS Alerts: Subscribing to RCS or SMS alerts allows us to send automated text messages including promotional offers, travel reminders, booking updates, and service notifications. Message frequency varies. Standard message and data rates may apply. You may opt out anytime by replying STOP to any text message. Contact support@zoomflightz.com for assistance.

False Information Warning: TO KNOWINGLY INPUT FALSE INFORMATION, INCLUDING FAKE NAMES, PHONE NUMBERS, OR EMAIL ADDRESSES, IS A SERIOUS FRAUDULENT MATTER RESULTING IN SUBSTANTIAL COSTS AND DAMAGES. YOU AGREE TO FULLY INDEMNIFY AND HOLD HARMLESS ZoomFlightz AND ALL TRAVEL SERVICE PROVIDERS FOR ANY DAMAGES ARISING FROM FALSE CONTACT INFORMATION.

Contract of Carriage: The official contract of carriage when issued exists solely between the passenger and the operating airline. Airlines retain the right to adjust flight schedules, aircraft equipment, and itineraries at any time.

Dynamic Pricing & Inventory: We attempt to maintain accurate pricing. In the event an airfare is listed incorrectly due to carrier typographical or technical error, the Company and airline reserve the right to cancel the request prior to payment processing.

Code Share Flights: Flights marketed by one carrier may be operated by a partner airline ('operated by'). Travelers check in with the operating carrier.

Hazardous Materials Warning: Federal law forbids the carriage of hazardous materials aboard aircraft in luggage or on person (49 U.S.C. 5124). Violations carry severe criminal penalties and fines up to $250,000.

Prohibited Ticketing Practices: Travelers agree not to engage in 'hidden-city', 'point-beyond', or 'back-to-back' ticketing practices prohibited by airlines. Airlines require flight coupons to be flown in sequential order; failure to use an outbound segment invalidates all subsequent segments without refund.

Taxes & Government Fees: All published airfares include mandatory government taxes, passenger facility charges, and agency fulfillment fees. Retroactive tax rate increases imposed by taxing authorities remain the traveler's responsibility.

24-Hour Rule: Airfares and agency booking fees are non-refundable after 24 hours. Qualifying reservations booked at least 7 days prior to departure may be eligible for cancellation within 24 hours of booking, subject to applicable supplier and processing fees.

Beyond 24 Hours: Cancellations beyond 24 hours are subject to airline penalties. Most discounted economy tickets are non-refundable and non-transferable. Where airlines allow itinerary changes, airline change fees typically range from $75 to $300+ USD per ticket, plus fare differences.

No-Show Forfeiture: If a passenger is not present at the airport gate ('no-show'), the ticket is 100% forfeited by the airline with no refund or waiver. To prevent forfeiture, notify our desk at 1855-511-4614 at least 4 hours prior to departure.

Refund Request Procedure: All cancellation and refund requests must be initiated by phone with our customer service desk. Receiving an acknowledgment email confirms receipt of your request but does not guarantee a refund. Approval is at the sole discretion of the supplier. Once approved, supplier refunds typically take 60 to 90 days to appear on your payment statement.

Agency Service Fees: Original booking and service fees are strictly non-refundable. Post-ticketing service fees charged by ZoomFlightz are applied per passenger, per ticket for processing changes, refunds, or supplier waivers.

Baggage Tariffs: Most airlines charge fees for checked baggage, ranging from $15 to $200+ per bag depending on size, weight, and route. Basic economy fares may exclude free carry-on bags. Check directly with your validating carrier for current baggage fee schedules.

Special Requests: Seat assignments, special meals, wheelchair requests, and frequent flyer mileage are treatable as requests only and cannot be guaranteed by ZoomFlightz. Contact the operating carrier directly to confirm special accommodations.

Web Check-In: Electing automatic web check-in authorizes ZoomFlightz to accept airline conditions of carriage on your behalf at the time of check-in.

Combo & Multi-City Fares: Certain discounted itineraries comprise two or more separate one-way tickets on different airlines. Each ticket is governed independently; a change or cancellation to one ticket does not alter the other ticket, and separate change fees apply to each ticket.

Entry & Exit Fees: Certain international destinations impose departure or entry airport fees collected locally that are not included in your ticket price.

Nature of Price Lock: The Price Lock fee is non-refundable. When exercised, the lock fee is adjusted toward the total ticket price at the time of final payment. The Lock protects against fare increases during the Lock Exercise Time; if the fare rises, the Company covers the difference on your behalf.

Scope & Exclusions: Price Lock covers 100% of the locked-in base airfare but excludes ancillary items (baggage fees, seat selection, upgrades, travel insurance). Price Lock is offered only for eligible flights departing more than three (3) days from lock expiration.

Exercising the Lock: The Lock can be exercised at any time prior to the expiration time through the checkout process. Exercising the Lock purchases the underlying ticket. If a Lock expires unexercised, rights are extinguished and no refund is permitted.

Natural Disasters: In case of price increases caused by natural disasters, acts of God, or emergencies, the Lock will be invalidated and the lock fee refunded.

Hotel Bookings: Primary guests must be at least 18 years of age and present a valid photo ID and credit card upon check-in. Room types, bedding preferences, and smoking preferences are treated as requests only. Resort fees and local hotel occupancy taxes may be charged directly by the hotel upon arrival.

Car Rentals: Vehicle rentals are subject to the rental car company's standard contract. ZoomFlightz acts as an intermediary; your credit card guarantees the reservation and estimated charges are due at pickup. Drivers must present a valid driver's license and credit card.

Featured Airport Parking: ZoomFlightz acts as an agent for featured car park service providers. Customers enter into a direct contract with the parking operator. Booking confirmation vouchers must be presented upon arrival. Cancellations must be made at least 24 hours prior to scheduled arrival.

Amex Card Discount: A 2% discount on the total amount may be available for American Express cardholders on eligible fares. The discount applies only to the portion paid via Amex and is not applicable when using alternative payment options.
